What service does MiAcademi provide? MiAcademi provides customers with access to its Online Learning Platform whereby learners can gain essential knowledge on Compliance training topics for the Financial Sector. Learners complete training modules and take tests. Downloadable personalized certificates and reports evidence course completion. The robust reporting suite provides organizations with learner status reports on training progress and course completion.
In providing this service, is MiAcademi processing personal data belonging to its customers? Yes. The following data is stored securely on the Learning Management System (Moodle LMS) for the purpose of customizing the users' experience based on their profile and also to enable them to access the LMS, complete courses, access resources, record learning progress and download personalized certificates and reports:
  • Personal details: name(s);
  • Contact details: email address; phone;
  • Employment details: name of current employer;
  • Electronic Identifying Data: IP addresses; cookies; activity logs; online identifiers; unique device identifiers; and geolocation data.
Who has access to the personal data of customers? All members of the Amicorp Academy team. Also, assigned employees from the clients' organization (Managers and HR personnel, can be given access to learning progress reports for employees in their organization).
Does MiAcademi process sensitive special category data? No.
What security standards does MiAcademi have in place to keep personal data secure? We take our customers' privacy and security very seriously. Amicorp's Compliance, Legal and IT team work very hard to ensure data security. Refer to Amicorp's Privacy Notice.
How often are MiAcademi policies and procedures reviewed? Annually.
Does MiAcademi appoint other companies or organizations to process personal data? Yes. MiAcademi works with external third-party service providers to support and host the LMS, the IT infrastructure and website. MiAcademi carries out due diligence on third-party suppliers related to their position on GDPR. Access to organization data and individual learner data is allowed only for system testing purposes. We do not, and will never, sell or share your personal information with third parties for marketing purposes.
Does MiAcademi have signed contracts and statements of work between with third parties? Yes. Contracts are reviewed annually, or when renegotiating continuity of service.
How is this data gathered? MiAcademi gathers varied data from or pertaining to you based on your usage of the Services. Below are a few instances to elucidate the types of data we gather.

Upon creating an account and utilizing the Services, whether directly or via a third-party platform, we collect any data you provide directly, including:
  • Account Data: To access specific features such as content, it is necessary to establish a user account. This entails the collection and retention of your name, email address, password, and account settings. Additionally, you might be asked to provide supplementary details such as your company name, country of residence, and phone number. Upon the creation of your account, a distinct identifying number is allocated to you.
  • Profile Data: You have the option to add additional profile details such as a photo, city of residence, timezone, biography/description, interests, department, mobile phone, address, or other information. Your Profile Data will be visible to the public.
  • Learning Data: When accessing content, we gather specific information such as the courses, assignments, workshops, and quizzes you've initiated and finished; details regarding content and subscription purchases and credits; subscriptions; certificates of completion; as well as essays, responses to questions, and other materials submitted to fulfill course and associated content criteria.
  • Payment Data: When making purchases, we gather specific information about your purchase (such as your name, and billing address) necessary for order processing, which may optionally be retained for future transactions. Certain payment and billing details must be provided directly to our payment service providers, including your name, credit card information, billing address, and country/region. Additionally, we may receive limited information from payment service providers, such as notification of a new card and the last four digits of the card, to facilitate transactions. For security reasons, MiAcademi does not collect or store sensitive cardholder data, such as complete credit card numbers or authentication data
  • Communications and Support: If you reach out to us for assistance or to report an issue or inquiry (regardless of whether you have an account), we gather and retain your contact details, messages, and additional information about you, such as your name, email address, message content, location, MiAcademi user ID, refund transaction IDs, and any other information provided by you. This information is utilized to address your queries or concerns and conduct research, all in compliance with this Privacy Policy.
What is the legal basis for processing your personal data? In accordance with the current Data Protection Legislation, we Process your Personal Data on the following legal grounds:
  1. Processing is necessary for the performance of the contract(s) entered into with you or in order to take steps at your request prior to entering therein: Personal Data is Processed in order to provide services in accordance with the contract(s) with our clients or to take pre-contractual measures in preparation thereof. The purposes of Data Processing depend primarily on the concrete product (corporate services, fund services, bank account, client referral) and can include needs assessments, advice and support. You may find other details about the purposes of Data Processing in the relevant contract documents.
  2. Processing is necessary to comply with a legal obligation to which Amicorp is subject: We are subject to various legal duties: such duties may include identification checks (know-your-customer), fraud and money laundering prevention and detection, fulfilling control and reporting obligations under fiscal laws, regulatory reporting. For these purposes, we may Process Personal Data in relation to both the Client and any Affected Person, as the case may be.
  3. Processing is necessary to pursue out legitimate business interests: Process your Personal Data, beyond the actual performance of the contract or legal obligations, to fulfil out legitimate interests, such as: improving products and services, asserting legal claims and defense in legal disputes, guarantee of the our IT security and IT operation, prevention and detection of frauds, video surveillance to protect the right of owner of premises to keep out trespassers, for collecting evidence in hold-ups or fraud, measures for building and site security (e.g. access controls), measures for business management and further development of services and products, risk management and reporting, compliance, internal supervision and internal audit, creating statistics, marketing of our products and services (to the extent it does not involve profiling).
    Whenever we intend to rely on legitimate interest as the legal basis for the Processing of Personal Data, we will give due consideration to your and any Affected Person's rights and freedoms.
  4. Processing is based on your consent: If we have been granted consent to Process your Personal Data relating or any Affected Person for certain purposes (e.g. for marketing of our products and/or services), the related Processing of Data is based on the data subject's consent. Consent given can be withdrawn at any time. However, withdrawing your consent will not affect the Data Processing carried out before the withdrawal, nor will prevent Amicorp from Processing your Personal Data based upon other legal grounds (listed under a) to c)).
Which are the purposes for which we may process your personal data? The purposes for which we may process your personal data are:
  • on-boarding new clients; and compliance with our internal compliance requirements, policies and procedures;
  • maintaining and updating your contact information where appropriate;
  • Marketing and promotional activities;
  • providing you with information or assistance that you request from us;
  • conducting verifications, monitoring and reporting in accordance with anti-money laundering and counter terrorist financing laws;
  • providing our clients with the services requested, including administration, corporate and trust, banking, custody, middle office services, financial products, reporting and tax services amongst others;
  • notifying you or our clients about changes to our services;
  • monitoring and improving the quality of our services;
  • quality assurance and training purposes.
International transfer of personal data We may transfer Personal Data to Data Recipients located countries outside the European Economic Area. Such transfer takes place so long as:
  • A country has been recognized by the EU Commission as guaranteeing adequate level of data protection (in particular, Switzerland), or
  • We have executed the Standard Contractual Clauses as adopted by the European Commission (the “SCCs”) with the Data Recipient, or
  • It is necessary for the performance of a contract between the Client and the Bank or implementation of the pre-contractual measures taken at your request (e.g. for the purpose of carrying out your orders (e.g. payment and securities orders), even if the recipient country has not been recognized by the EU Commission as guaranteeing adequate level of data protection, or
  • the Client has granted us an explicit consent, even if the recipient country has not been recognized by the EU Commission as guaranteeing adequate level of data protection.
These transfers will always be carried out in compliance with confidentiality obligations regarding all client-related matters of which we acquire knowledge and only to fulfil the purpose for which data have been collected.

Likewise, and in accordance with article 49 GDPR, international data transfer can be carried out in cases in which consent, is given by the interested party, it is necessary for the for the conclusion of a contract, for public interest, defense of claims and public registration.

What rights do you have regarding the process of your personal data? Subject to applicable law, you may have a number of rights regarding the processing of your personal data, including:
  • the right to request access to, or copies of, your personal data that we process or control, together with information regarding the nature, processing and disclosure of those personal data;
  • the right to request rectification of any inaccuracies in your personal data that we process or control;
  • the right to request erasure or restriction of your personal data that we process or control;
